Hello Boulder Action members! Please read below about the lawsuit fund for Save South Boulder. The city has been accused of illegalities and deceptions in the past and if this group is successful it will send a strong message that accountability still matters to our city. Although we seldom if ever mention donations in our communications we hope that you will be able to contribute to this worthy cause that Boulder Action strongly supports. Many thanks, Boulder Action Team ___________________________________________ Dear Long-Time Friends of Save South Boulder, South Boulder Creek and the Environment: Great News and a Big Ask!!! Startling new developments in the fight against the dam project mean we might have a chance to both stop it and preserve the habitat at CU-South!! And to do this, Save South Boulder is in urgent need this week of donations of several thousand dollars from anybody who can help. Save South Boulder is filing a lawsuit by this Thursday, April 3 against the City of Boulder regarding illegalities in the City Council’s March 6 vote to proceed with a bond issue to pay for the dam project on South Boulder Creek. We paid $5000 to environmental lawyer Randall Weiner to evaluate our case, prepare for, and file a lawsuit. We now need $5000 more for Thursday's filing. And we will need an additional $5000 to fight off the motion to dismiss our lawsuit by the City of Boulder’s attorneys—which we fully expect immediately thereafter. Save South Boulder has $2200 in its bank account, but we must raise the rest to proceed. And time is critical. By City law, we must file the lawsuit before April 3. Almost immediately afterwards, we will need legal help to fight the City’s motion to dismiss. And there will be more expenses as the lawsuit proceeds. Why Is This Critical? This Is a Crossroads! We either proceed with a lawsuit now, or we give up and go home. Save South Boulder and its friends believe that this fight is far too important to give up on now. We’ve been fighting this fight for years. Some of us have been at it for decades. We can’t bear the thought of seeing a hugely ineffective flood project built across the South Boulder Creek Floodplain, destroying it and its environment. The New Legal Grounds: We lost any traction to sue the City on environmental grounds because the US President gutted the EPA and all its environmental protective regulations and laws. But Boulder’s City Council made three questionably legal moves on March 6, giving us new grounds on which to sue the City and potentially, stop the dam construction project cold. It a) passed a new “emergency” ordinance to request a bond issue to pay for the SBC flood mitigation project; b) it then unveiled its plan to pay the bonds back via increased stormwater fees on c) all households and businesses in the City. We're suing the City to stop these actions. Right now, we are calling on you specifically because of your long commitment to and knowledge about this whole project. We’ll be doing further fundraising immediately, but right now, we have an imminent funding emergency! We have to pay Randall Weiner to handle the lawsuit before he actually files it. We can’t lose this stellar opportunity to fight back. We know that this is a big ask, and we only ask you to contribute as much as you can now. Even $100 would help, but more would be so appreciated! Remember: We will need $10,000 to really get past the City’s motions and obstacles. And after that, we probably will have further expenses. But we think it's our only chance to prevail.
